BHOPAL: The Madhya Pradesh high court has asked for the medical examination of a woman who has prayed to release her husband from jail for a month so that they can have a child.
The husband is serving a sentence in Indore central jail. Her counsel has referred to a Rajasthan high court order that said the right to procreate is a Fundamental Right. He also referred to Supreme Courtorders on conjugal rights of prisoners and said the petitioner should also be given a chance to bear a child from her husband.The government counsel opposed the plea, contending the petitioner is “past the age of procreation” and cannot procreate either naturally or through artificial methods as she has attained the age ofmenopause.
